Militia is not going to investigate beating of the legal expert and the ecologist Evgenie Mamula
Active worker of Abinsky department of "Public commission on struggle against corruption" and the Ecological Watch across Northern Caucasus Evgenie Mamula received an answer to his claim from the Department of internal affairs on Abinsky area of Krasnodar region. On May, 11th, 2010 he had been beaten by director of Abinsky forest area of Official body of Krasnodar region "Committee on wood" Alexander Aristov.
In the "notice" addressed to Mamula only after his personal visit to militia, it was informed that his letter was ostensibly submitted to the first instance court of Abinsk town (the judicial site #114) in conformity with clauses 123-125 of the Criminal-Proceeding Code of Russian Federation and on the ground that director of Abinsky forest area Aristov had submitted a counter claim.
Absurdity of the reply which in the Depatment of inner affairs they had been composing more than two weeks, having broken all the official terms, even is not that the competence of the first instance court does not have to consider messages on crimes and, especially, restricting decisions on such affairs. It is that clauses of the Criminal-Proceeding Code of Russian Federation militia mentioned, concern the order of consideration and the appeal of investigatory actions within the limits of the instituted criminal proceeding.
Department of inner affairs on Abinsky area not only had not instituted a criminal proceeding on the fact of committing against Evgenie Mamula of physical injuries, but even, as it follows from the answer, did not organized pre-investigating actions. Than what was militia engaged in for two weeks?
It is known that Aristov is closely connected with separate employees of militia. Obviously, that is the reason of that militiamen considering Mamula’s claim, had to invent a legislative "know-how": beating and committing of harm to health, under the version of Abinsk militia, now appears to be investigated within the limits of the first instance legal proceedings.
From the first instance court Mamula had not received any summonses yet. The legal expert is going to appeal against "notice" he had received, in the Office of Public Prosecutor and in court.
Evgenie Mamula is investigating for the second year the facts of mass illegal timber works of the wood in the natural boundary "Dark Grove” located in the area of Kholmsky settlement. Alexander Aristov is involved in those activities.
