28/6/2007 The RF Constitutional Court upholds the decision not to give the militants' bodies out
Today, the Constitutional Court of the Russian Federation (RF) has announced its decision on the complaint of the parents of militants Kunak Guziev and Elena Karmova who perished in Kabardino-Balkaria. The Court has upheld the provision of the Law "On Burial and Funeral Business" regarding the non-giving out of terrorists' bodies, however, the Court has recognized it illegal to bury the bodies of such persons prior to decision of the court to recognize them guilty of terrorism or not.
We remind you that the Office of Public Prosecutor of the South Federal District (SFD) stopped the criminal cases in relation to the persons who perished in October 2005 in Nalchik because of their death. When making the corresponding decisions, the investigation noted that the decisions could be appealed against; however, without waiting for any appeals, it decided to bury them.
These actions were recognized illegal by the Constitutional Court. The Court has also concluded the necessity to add the Law with a provision on burial according to the religious affiliation of the casualty.
The "Caucasian Knot" has reported earlier that on June 14 the Constitutional Court considered the application of the parents of the militants who perished in Kabardino-Balkaria with participation of the parties. The Court listened to the arguments of the parents' advocates Larissa Dorogova and Tatiana Psomiadi, on the one hand, and representatives of the RF State Duma, on the other hand.
