The case on protection of the rights of the indigenous people of Krasnodar territory - Adygs-Shapsugs - grows as a snowball. The authorized representative Zaurbek Shu informed that to IА REGNUM correspondent on November 12th. We shall remind, on September 14th this year Haret Tesheva and Islam Napso had sent their applications to Lazarevsky district court of Sochi town - "About contest of inactivity of the institutions of the local government and recognition partially invalid the statutory act of the institutions of the local government". However that judicial instance made a definition about returning of the applications on the basis of that that case should be considered in another instance - the Central district court of Sochi.
According to Shu, that verdict could have been challenged in the cassation order. However, the authorized representative notified, it would be interfaced to the great and useless expenditure of time. Therefore the applicants (on October 17th) addressed to the judicial instance that was mentioned in the received definition.
Those applications were considered in 10 days. The court by its decision left them "without movement". In the substantiation of the definition, sent to each of the applicants, appeared: “Actually a dispute about the right on payment (about releasing of payment of the land tax) for concrete land site takes place". Therefore the judge of the Central district court of Sochi Sergey Martynenko in each of the definitions "leaves the application without movement and explains to the applicants necessity of registration of the claim about releasing of payment of the land tax concerning the indigenous small people of Krasnodar territory of Russian Federation - Shapsugs on the concrete land site". In other words, Shu explained, the judge, not denying that the applicants are representatives of the indigenous people of Russian Federation, specified to them that they had been only trying to solve some private questions. So it was just the question of the tax payments.
But, as the authorized representative Shu explained, the question of the taxes for the applicants was the passed stage. They addressed with it to different instances: the Interdistrict inspection of the federal tax service of Russia across Krasnodar territory, to the Sochi Town assembly; they also addressed to Sochi mayor Victor Kolodjazhny. The answers from those instances (if they were) were reduced to that ‘the taxes must be paid, as there are no any privileges for the Shapsugs in the legislation of Krasnodar territory and Sochi municipality’.
In federal judge Martynenko’s definition, as Shu considered, absence of depth of studying of the problem put in the application could be obviously seen. The problem stated in the application, certainly, was not about the concrete land sites, and about the rights of the applicants - representatives of the small people – their rights for the privileges fixed by the federal law "About guarantees of the rights of the small peoples of Russian Federation". And after that in particular - about releasing of payment of the land tax. That is, the first is the rights of the indigenous people and only for the second - the privileges. "Therefore, despite of the judicial red tape, representatives of the indigenous people of Russian Federation are adjusted to struggle for restoration of their broken rights and their interests protected by law", - the authorized representative emphasized.
Let's remind, two days ago the public of Adygeya on behalf of the republican organization "Nafna" ("Habza") declared their support for the group of enthusiasts from the Black sea Shapsugia.
