Nalchik Indictment Rewrites Recent History

The prosecution at the trial of 58 young men charged with participating in the October 13, 2005, multiple attacks on police and security facilities in Nalchik, capital of the Kabardino-Balkaria Republic (KBR), has begun to read out the formal indictment against them. The document contains a number of factual errors.

Meanwhile, lawyers for the accused continue to protest the recent legislative amendments that deny persons accused on charges related to "terrorism" the right to a jury trial.

Marina Bottaeva, 20, a resident of Nalchik, addressed human rights organizations with an application that he was blackmailed by a law enforcer named Arsen Iritov, born in 1985, a relative of Naurbi Zhamborov, Deputy Minister of Internal Affairs.

"Since December 2007 I was meeting with militiaman Arsen Iritov. We had serious relations and were going to get married. But he concealed from me the fact that he was in civil marriage with another woman. This circumstance caused me to break relations with him. My decision provoked his negative reaction. He repeatedly exerted moral and physical pressure on me, beat me, threatened and offended," runs Ms Bottaeva's statement. She writes that last November Iritov threatened her with his service pistol; another case of this sort took place on February 19.

Defendants in Nalchik attack case refuse to plead guilty

The majority of defendants who figure in the criminal case on the events on October 13, 2005, in Nalchik refuse to admit their guilt. Some of them have admitted only the charge under Article 222 of the Russian Criminal Code - "Bearing and storage of arms".

At today's session of the Supreme Court of Kabardino-Balkaria, the defendants and their advocates have expressed their attitude to the indictment. 

The debate of the bill of particulars started with the speech of advocate Anatoly Kunizhev who stated that "it's impossible to agree that the defendants wanted to tear away a small territory from the great country and create an Islamic state." In his opinion, the tragedy was a result misunderstanding between believers and the authorities.

"Believers came to the mosque, but it was closed. The militia stated that people were doing something illegal in mosques. ...
