The head of the Georgian social movement "On our own" Paata Davitaja on MARCH 21ST addressed to the government of Georgia with request to incur continuation of his private claim to the Office of Public Prosecutor of the International criminal court in the Hague on case "About happened in Abkhazia genocide against Georgian population and war crimes". "Three days ago I had received a letter from the Hague in which they wrote that the Office of Public Prosecutor of the International criminal court had had given the following qualification to the statement of the claim presented by me: the Office of Public Prosecutor considers the crimes taking place in the territory of Abkhazia under two clauses of the Roman statute, - informed today the journalists Davitaja, - They are the sixth clause - genocide, and the eighth clause - war crimes".

He noted that according to the letter received from the Hague tribunal, the Office of Public Prosecutor of the International criminal court can begin investigation of the crimes committed in the territory of Abkhazia since December 1st, 2003 as the court’s powers have been carried out since that time. "The Office of Public Prosecutor of the Hague court will agree to institute a criminal case if in the nearest future additional proofs of the crimes under clauses concerned war crimes and genocide of the Roman statute is presented to it, - the lawyer informed. -That is an unprecedented case, and if such criminal case (and I am assured of that) is instituted it will have completely changed the situation developing in relation to Abkhazia". According to Paata Davitaja, in the world yet there was no precedent of institution by the Office of Public Prosecutor of the Hague tribunal a criminal case concerned crimes against humanity on base of a private claim, as the case about the genocide and the war crimes in Abkhazia is the first such case accepted in its office-work.

Davitaja noted that not being the public prosecutor, he is not authorized to investigate accomplished on the territory of Abkhazia any criminal offences, and has no powers to represent corresponding proofs to the international Office of Public Prosecutor. "Brief messages represented by me concerned the crimes became the basis for institution of criminal case on crimes in the territory of Abkhazia. Now I address to the government of Georgia with request to incur responsibility for continuation of this case in the Office of Public Prosecutor of the International criminal court in the Hague", - declared Paata Davitaja, having mentioned that the Georgian authorities should have started investigation of the crimes accomplished on the territory of Abkhazia since December 1st, 2003 and have instituted criminal cases on all the facts of such offences. The lawyer also noted that if the government of Georgia did not become interested in that case within a month he would try to begin investigation on his own.

It is necessary to note that earlier Paata Davitaja in his interview to IА REGNUM had declared that within the limits of the "Abkhazian" case involving of the Hague tribunal to punishment of the Russian militarians was possible.
